{"id":41633,"date":"2014-04-17T06:12:16","date_gmt":"2014-04-17T10:12:16","guid":{"rendered":"http:\/\/www.hedgeco.net\/news\/?p=41633"},"modified":"2014-04-16T16:26:21","modified_gmt":"2014-04-16T20:26:21","slug":"hedge-fund-law-sec-names-david-gottesman-as-deputy-chief-litigation-counsel","status":"publish","type":"post","link":"https:\/\/hedgeco.net\/news\/04\/2014\/hedge-fund-law-sec-names-david-gottesman-as-deputy-chief-litigation-counsel.html","title":{"rendered":"Hedge Fund Law: SEC Names David Gottesman as Deputy Chief Litigation Counsel"},"content":{"rendered":"<p><a href=\"http:\/\/www.hedgeco.net\/news\/wp-content\/uploads\/2010\/08\/OB-JB329_sec062_G_20100628203904.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-17041\" alt=\"SEC\" src=\"http:\/\/www.hedgeco.net\/news\/wp-content\/uploads\/2010\/08\/OB-JB329_sec062_G_20100628203904.jpg\" width=\"234\" height=\"214\" \/><\/a>New York (HedgeCo.Net) &#8211; \u00a0A member of the team that obtained admissions of liability as part of an $18 million settlement with hedge fund adviser Philip Falcone and his advisory firm Harbinger Capital Partners has been appointed as deputy chief litigation counsel in the Division of Enforcement by the SEC.<\/p>\n<p>David J Gottesman\u00a0said, \u201cI am honored to have the chance to serve as deputy chief litigation counsel.\u00a0 I look forward to continue helping the Enforcement Division carry out its mission of protecting investors and the markets.\u201d<\/p>\n<p>This is not the same David Gottesman who is friends with Warren Buffet and a hedge fund billionaire in his own right.<\/p>\n<p>Gottesman has successfully led several jury trials on behalf of the Commission, including a two-week jury trial that concluded with a finding of liability for accounting fraud against former executives of Hayes-Lemmerz, an international auto parts supplier.<\/p>\n<p>He also led one of the SEC&#8217;s financial crisis cases against two former executives of Charles Schwab &amp; Co. for misleading statements and omissions in marketing the Schwab YieldPlus Fund.\u00a0 The defendants&#8217; settlements included significant civil money penalties and industry bars or suspensions.<\/p>\n<p>Matthew C.
