HedgeCo.net – The new Arabic language facility introduced by the General Registry in Cayman will trigger more valuable business from the Islamic region, according to a leading funds lawyer.<\/span><\/p>\n

 Ogier partner Gray Smith, who practices Cayman law from<\/span> London<\/span>, said that the innovative move demonstrated Cayman\u00c3\u00a2\u00e2\u201a\u00ac\u00e2\u201e\u00a2s recognition of the<\/span> Middle East<\/span> as an important area for new business.<\/span><\/p>\n

 \u00c3\u00a2\u00e2\u201a\u00ac\u00c5\u201cWe can now use both Arabic and English names on all documents when setting up a company and can also open bank accounts in both names. Previously we had to use only an English translation. The same ethos was applied to Chinese characters a few years ago and that was of huge benefit in<\/span> Hong Kong<\/span>, where both English and Chinese are used widely,\u00c3\u00a2\u00e2\u201a\u00ac\u00c2\u009d he said.<\/span><\/p>\n

 Gray said that Cayman law particularly lent itself to Islamic finance structures because of its flexibility. It has become a centre for \u00c3\u00a2\u00e2\u201a\u00ac\u00c5\u201csukuks\u00c3\u00a2\u00e2\u201a\u00ac\u00c2\u009d \u00c3\u00a2\u00e2\u201a\u00ac\u00e2\u20ac\u0153 bond issues that are Shari\u00c3\u00a2\u00e2\u201a\u00ac\u00e2\u201e\u00a2a compliant, prohibit interest payments and require tangible assets or equity as collateral.<\/span><\/p>\n

 \u00c3\u00a2\u00e2\u201a\u00ac\u00c5\u201cIt\u00c3\u00a2\u00e2\u201a\u00ac\u00e2\u201e\u00a2s straightforward, the processes are relatively easy and it\u00c3\u00a2\u00e2\u201a\u00ac\u00e2\u201e\u00a2s very flexible, allowing for the drafting of articles and agreements that comply with the restrictions of Islamic law. Cayman is also a lighter regulation jurisdiction and a widely recognised international finance centre which suits<\/span> Middle East<\/span> companies looking for investments.\u00c3\u00a2\u00e2\u201a\u00ac\u00c2\u009d<\/span><\/p>\n

 Gray also predicted further inflows of money into the<\/span> Middle East<\/span> as clients are increasingly marketing their funds outside the region.<\/span><\/p>\n

 \u00c3\u00a2\u00e2\u201a\u00ac\u00c5\u201cThe inflow to<\/span> Middle East<\/span> funds is a new growth area. Furthermore, the establishment of the Dubai Finance Centre will enable the listing of Cayman funds on the Dubai Stock Exchange and dual listing, in Cayman the Middle East or the Middle East and the UK,\u00c3\u00a2\u00e2\u201a\u00ac\u00c2\u009d he said.<\/span><\/p>\n

 Ogier is involved in significant investment fund work in the<\/span> Middle East<\/span>, with a range of underlying assets, including real estate and private equity, as well as securitisation work.<\/span><\/p>\n
